Refund Policy

1. Legal Disclaimer

The explanations and information provided in this Refund Policy are general in nature and are intended to outline the refund framework for Anthony’s Kar Sales. This document does not constitute legal advice and should not be relied upon as such.

Anthony’s Kar Sales recommends that independent legal advice be obtained to ensure this policy complies with all applicable Commonwealth and State legislation, including but not limited to the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth).

2. Purpose of This Policy

This Refund Policy establishes the legal relationship between Anthony’s Kar Sales (“we”, “us”, “our”) and our customers (“you”, “your”) regarding refunds, returns, exchanges, deposits, and cancellations.

As a motor vehicle dealer operating in Australia, this policy is designed to:

  • Comply with Australian Consumer Law (ACL)

  • Provide transparency regarding your rights

  • Reduce misunderstandings about refunds and returns

  • Set clear expectations for both parties

Nothing in this policy excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.

3. Your Rights Under Australian Consumer Law

Under the Australian Consumer Law, customers are entitled to a remedy (repair, replacement, or refund) if a vehicle:

  • Has a major failure, or

  • Fails to meet a consumer guarantee

A major failure includes (but is not limited to):

  • The vehicle would not have been purchased had the customer known about the problem.

  • The vehicle is significantly different from the description provided.

  • The vehicle is unsafe.

  • The vehicle has a serious fault that cannot be fixed within a reasonable time.

If a major failure occurs, you are entitled to choose:

  • A full refund, or

  • A replacement vehicle (where available)

If the issue is minor, we may choose to:

  • Repair the vehicle within a reasonable timeframe.

4. Change of Mind

Anthony’s Kar Sales does not provide refunds for change of mind.

We are not required to provide a refund or exchange if:

  • You change your mind

  • You found the vehicle cheaper elsewhere

  • You decided the vehicle is not suitable for your personal preference (unless it was misrepresented)

Any goodwill refund or exchange is strictly at management discretion and must be confirmed in writing.

5. Holding Deposits

​

Deposits paid to hold a vehicle may be:

  • Refundable or

  • Non-refundable

This will be clearly stated on your sales agreement or deposit receipt.

If a deposit is marked non-refundable, it will not be returned if:

  • You withdraw from the purchase without legal justification.

  • Finance is declined due to inaccurate or incomplete information provided by you.

If finance is declined through no fault of the purchaser and all reasonable steps were taken, the deposit may be refunded at management discretion.

6. Used Vehicles

As most vehicles sold by Anthony’s Kar Sales are used vehicles, customers acknowledge:

  • Used vehicles may have reasonable wear and tear consistent with age and kilometres.

  • Minor cosmetic imperfections do not constitute a major failure.

  • Pre-purchase inspections are encouraged prior to sale completion.

Statutory warranties (where applicable under State law) will apply in addition to ACL protections.

7. Timeframe for Refund Requests

If you believe a vehicle has a fault that qualifies for a remedy:

  • You must notify us as soon as reasonably practicable.

  • We may require inspection of the vehicle.

  • The vehicle must not be modified, altered, or repaired by a third party without our written consent.

Failure to notify us promptly may affect your ability to claim certain remedies.

8. Conditions for Refund Assessment

To assess a refund claim, we may require:

  • Proof of purchase

  • Vehicle inspection at our premises or approved repairer

  • Details of the issue in writing

Refunds will not be provided where:

  • The fault was caused by misuse, neglect, accident, or modification.

  • The vehicle has been damaged after purchase.

  • The issue was clearly disclosed prior to sale.

9. Refund Process

If a refund is approved:

  • The refund will be processed via the original payment method where possible.

  • Processing may take up to 10 business days.

  • Any agreed usage or kilometre adjustment (where permitted by law) may be deducted.

10. Trade-In Vehicles

Once a trade-in vehicle has been:

  • Valued,

  • Transferred, and

  • Incorporated into the transaction,

it may not be recoverable if the contract is cancelled unless required under Australian Consumer Law.

11. Finance Contracts

If your vehicle purchase is linked to a finance agreement:

  • Cancellation may require lender approval.

  • Refunds will be subject to the terms of the finance contract.

  • Any fees incurred by third-party finance providers may not be refundable.
